Randall L. Klein

Randy Klein is a Principal at Goldberg Kohn and Co-Chair of the firm’s Bankruptcy & Creditors’ Rights Group. He concentrates his practice in the protection and enforcement of creditors’ rights. Mr. Klein is nationally recognized as a leader in his field, and for his experience in the drafting and enforcement of intercreditor agreements and unitranche agreements. He participated extensively in the drafting of the Loan Syndications and Trading Association's (LSTA) Form of Agreement Among Lenders, published in 2019, and has been a frequent lecturer on the topic. He also served as Vice Chair of the ABA's Committee on Commercial Finance, Section of Business Law's Model Intercreditor Agreement Task Force, and was a contributing author of the Report and Model Form.

Monique Jewett-Brewster

Monique Jewett-Brewster is Chair of the Financial Institutions and Creditors Rights Practice Group and a member of Hopkins & Carley’s Litigation Department in the San Jose office.  Monique has over twenty years of experience advising creditor clients in business bankruptcies and in all other aspects of insolvency law, with a primary focus on advocating for secured and unsecured creditors in the workout, restructuring and enforcement of commercial loan and other business transactions in state, district, appellate and bankruptcy courts nationwide. She also counsels the City of Oakland in its bankruptcy matters.

Marc B. Merklin

Marc Merklin is Chair of the Business Restructuring, Bankruptcy & Commercial Law Practice Group of Brouse McDowell. He focuses on general business counseling, commercial law and business reorganizations. He represents creditors, debtors, committees and trustees in Chapter 11 reorganizations, as well as borrowers in loan transactions and bankruptcy and commercial litigation. Marc also works on the sale and acquisition of financially distressed companies.
